Abortion-rights ballot measures pass in 7 states, fail in 3 others

"Constitutional amendments to protect or expand abortion rights passed in seven of the 10 states where they appeared on the ballot Tuesday, NBC News projects. Voters in Arizona and Missouri approved ballot initiatives that will effectively protect abortion rights until fetal viability and undo existing abortion laws on the books. But voters in Florida, Nebraska and South Dakota rejected proposed amendments that would have done the same — becoming the first pro-abortion-rights ballot measures to fail since the Supreme Court overturned Roe v. Wade in June 2022. Meanwhile, voters in Maryland, Montana, Nevada and New York (where abortion is already legal through fetal viability) and in Colorado (where there are…

"A Nebraska mother who was accused of helping her 17-year-old daughter have an illegal abortion and disposing of the fetus was sentenced to two years in prison on Friday, the Norfolk Daily News reported. The sentence comes after Jessica Burgess, 42, pleaded guilty in July to two felonies – removing, concealing or abandoning a dead human body, and performing an abortion beyond 20 weeks – and a misdemeanor charge of false reporting. CNN has reached out to Burgess’s attorney, the Madison County attorney and the Madison County District Court for comment...."

Nebraska judge allows abortion limits and restrictions on gender-affirming surgery

"A Nebraska judge on Friday rejected an effort to block a ban on abortions after 12 weeks of pregnancy and restrictions on gender-affirming surgery. Lancaster County District Court Judge Lori Maret sided with the state and allowed a law approved by the Nebraska Legislature earlier this year to remain in effect. The law outlaws abortion after 12 weeks of pregnancy with exceptions for rape, incest and to save the life of the mother. As of Oct. 1, it also will prevent people under 19 from receiving gender-affirming surgery and restricts the use of hormone treatments and puberty blockers for minors...."

Could Facebook messages be used in abortion-related prosecution?

"...In April 2022, Celeste Burgess, who was then 17, used medication to terminate a pregnancy when she was past 20 weeks, which was the cutoff in the state at the time. Celeste, now 18, is scheduled to be sentenced Thursday. Jessica will face sentencing in September...."

Nebraska expected to pass combo bill on abortion, gender-affirming care for minors

"Conservative Nebraska lawmakers are expected to have just enough votes to pass a bill Friday that combines a ban on gender-affirming care for minors with a 12-week abortion ban. The mood in the Nebraska Capitol since the hybrid measure was advanced Tuesday by a single vote has been volatile. Lawmakers have traded insults and promises of retribution on the legislative floor and protesters have loudly voiced their displeasure even in the days after vote...."

Nebraska Legislature votes to fold abortion ban into bill banning trans health care for minors

"Conservatives in the Nebraska Legislature got just enough votes Tuesday to fold a proposed 12-week abortion ban into a bill that would ban gender-affirming health for minors. As expected, the debate over the plan was raucous, with lawmakers opposed to the plan sparring angrily with Republican Lt. Gov. Joe Kelly, who presided over the Legislature, and accusing him of trashing legislative rules to help push through the plan. Multiple motions, calls for points of order and motions to overrule the chair stretched what was supposed to be a two-hour process to six hours...."

Could ‘single subject rule’ trip up merger of abortion and anti-trans bills?

Nebraska Constitution requires bills to have ‘no more than one subject,’ but the clause is mostly untested in court  "A blockbuster pairing of two controversial bills in the waning days of the 2023 state legislative session has state senators and advocates buzzing. But could a state constitutional requirement that bills contain only a “single subject” trip up the merging of a 12-week ban on abortions into a proposal to ban minors from having gender-affirming surgeries?..."

Conservative dissenters block abortion limits in Nebraska, South Carolina

The failure of strict new abortion laws to advance in two conservative-dominated legislatures on the same day this week signaled a mounting fear among some Republicans that abortion bans could lead to political backlash. " A near-total ban on abortion failed Thursday in South Carolina, just hours before a six-week ban fizzled in Nebraska. Abortion remains legal in both states until 22 weeks of pregnancy. In lengthy and often impassioned speeches on the South Carolina Senate floor, the state’s five female senators — three Republicans and two Democrats — decried what would have been a near-total ban on abortion. One, Sen. Sandy…
